By accessing, using, and downloading these Services, you agree to be bound by the terms of this Privacy Policy.
1.1. Information we collect directly from you, we will need the following information to create, run, manage your profile, and allow you access to and control of our Services:
1.1.1. Demographic information – name, date of birth, mobile number, e-mail address, physical address;
1.1.2. Health information – height, weight, vital details, fitness data, physical activity tracking, and such other information which you choose to be processed.
1.2. Information we automatically collect from you, we will need the following information to provide you with our Services:
1.2.1. Device information – unique ID of the SmartWatch, details of the mobile phone you have downloaded and installed Prospot on, OS version, Bluetooth information, access to other applications and content on the mobile device you are using to connect to the SmartWatch, notification access, including SMS notifications;
1.2.2. Location information – where you provide us access with your location information;
1.2.3. Usage information – the apps you access, time stamps, your activity on the SmartWatch and Prospot, content you view, your inputs on the Services;
1.2.4. Log-in details – if you choose to use Google profile to connect to the SmartWatch via Prospot, details of your connected Google account log-in;
1.3. Information we will receive about you, from the mobile/ portable device you are accessing the SmartWatch from, and have Prospot installed on, we will receive the following information to provide you with our Services:
1.3.1. Details about the devices you use to log-in to Prospot and access the SmartWatch, including details received from your telecom service provider for connectivity. For instance, you may instruct your carrier to share data for activation of your account with us;
1.3.2. Details about applications you have provided access to the SmartWatch;
1.3.3. Any other details we may use to validate your account with us.
1.4. We do not collect any further information from you, if not specifically mentioned hereinabove.
1.5. You can at any point of time, adjust app-specific permissions and limit access through your device settings, and through Prospot.
1.6. Note that where you are using other applications, and allow our Services to interact with such mobile applications, we do not have any control over their data/ information management practices, and they are governed by their own sets of privacy policies and practices. We urge you to familiarize yourself with their privacy policies and practices before you proceed to avail of their services, and allow them to interact with our Services.
2.1. We use your information for the following purposes:
2.1.1. Profile – to create, register and validate your account, profile with us, and allow your continued access to our Services;
2.1.2. Correspondence – to communicate with you, including responding to your inquiries and providing updates about our Services, and provide you with customer support;
2.1.3. Services – to provide notifications on your SmartWatch, and enable actions on your SmartWatch with connected mobile/ portable device;
2.1.4. Personalization – to customize, personalize, and improve our Services to you, to analyze your usage patterns and improve your user experience on our Services;
2.1.5. Marketing surveys and feedback – to conduct marketing surveys, and receive your feedback on our Services. We may also use your information to provide you with promotional offers, and e-mails where you have consented to the same;
2.1.6. Compliance with law – to comply with applicable laws and regulations, or, to comply with a lawful governmental request.
We do not use your information to make any decision that would significantly affect you without the opportunity for human review.
3.1. We do not share or disclose your information with third parties, except in the following circumstances:
3.1.1. Service Providers. We may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing information in connection with your use of our Services. Such third parties are obligated to handle your information, as per the terms of this Policy, and consistent with our instructions;
3.1.2. Others. We may share your information with others at your direction or with your consent, such as when we share information with your carrier or the linked Google profile to activate your account;
3.1.3. Governmental requests and lawful purposes. We may share your information with regulatory authorities, law enforcement agencies, and such other governmental agencies, to comply with legal requirements, protect our rights, or in the event of a merger, acquisition, or sale of all or part of our business;
3.1.4. Our affiliates. We may share your information with our affiliates where there is a lawful basis for such processing, and we commit that our policies and practices with respect to processing your information remain consistent across.
4.1. Our devices, web applications, and Services may use cookies and other technologies such as web beacons. Some of these cookies are used to enable network traffic to and from our servers; some are set as required to provide a specific feature or service that you have accessed or requested; and some cookies are used to understand how visitors interact with our websites and online services, including by helping us to assess the effectiveness of advertisements and web searches. If you do not wish for us to use cookies, we provide you with the means to disable their use, if you are using a web browser to access our Services, you can block access to Cookies from their settings.
5.1. We take reasonable security measures, and have industry commensurate technical and organizational measures in place to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is entirely secure, so we cannot guarantee absolute security. We urge you to ensure that when you access and use the Services, you ensure that access to it is limited to your exclusive personal use only, and that you do not share any passwords, or access to others.
6.1. We will keep your information for as long as we need it for the purposes for which it was collected, and where necessary. This may vary with the nature of the personal information so collected. Where we provide you with any Services, such as where you register, we will retain any information you provide to us at least for as long as we continue to provide that Services to you. In the event where you choose to reset your SmartWatch, we will still be retaining the information that was linked to our Services through Prospot, and the same will be available in our systems, you will have to write to us at appsupport@lavainternational.in requesting deletion of such available information, or deletion of your account with us.
ProWatch and ProSpot: Health & Fitness Services are not intended for medical diagnosis, treatment, or prevention of any disease. If you have a medical condition, particularly heart disease, consult your doctor before using ProWatch or starting a fitness program. In case of a medical emergency, seek immediate medical attention.

As a disclaimer, we would like to state that the application acts as a tracker of basic health metrics which gives users a directional indicator of their activities and fitness. The device does not suggest any medical condition or prescribe a medical course of action. Interpretation of data solely depends on the user, and it is strongly recommended to seek doctor’s advice for any medical interventions.
8.1. Your information may be transferred to and stored in locations outside of the territory of India. We will do this only when the destination jurisdiction has an adequate and appropriate level of protection and where the transfer is lawful.
8.2. When we transfer your personal information from your Home Country (country, state and city in which you are present) to the Alternate Country (another country, state and city), we will comply with our legal and regulatory obligations in relation to your personal information, including having a lawful basis for transferring personal information and putting appropriate safeguards in place to ensure an adequate level of protection for the personal information. We will also ensure that the recipient in Alternate Country is obliged to protect your Personal Information at a standard of protection comparable to the protection under applicable laws. We do not transfer your personal information to such countries for which we are not authorized under the applicable laws.
9.1. As a data principal, you have the following rights available to you, and may request us to:
9.1.1. access, update, correct the information you have provided to us;
9.1.2. seek erasure of your information available with us, subject to such conditions as permissible in law;
9.1.3. have means available of grievance redressal;
9.1.4. to nominate.
10.1. You are responsible for the following duties:
10.1.1. comply with the provisions of the applicable laws;
10.1.2. not impersonate another person, not suppress any material information;
10.1.3. not to register a false or frivolous grievance;
10.1.4. furnish only such information as is verifiably authentic, at the time of exercising other rights.
11.1. Our Services are not intended for children and are aimed at only persons who have attained the age of majority in their jurisdiction. We do not knowingly collect or use personal information from children under this age. 11.2. If our Services are being availed by a person with disability (as defined under the laws of the land), then the lawful guardian of such persons are required to provide us with their verifiable consent, and it is the duty of the person to communicate to us of such access.
12.1. We may update this Privacy Policy to reflect changes in our practices and offerings. When we make significant changes, we will provide notice through the SmartWatch, ProSpot or via e-mail. The version was last updated on [insert date] and archived versions can be obtained by contacting us.

13.2. Grievance Redressal. You have the right to direct your grievances with respect to the handling, management, processing of your information by us, and you can write to our privacy officer for the same. We will respond to you within such a prescribed timeline, as per the law.
13.3. You are duty bound to exhaust the opportunity of redressing your grievance through us, before approaching the Board, referred to at para 12 of this Policy.
